Property Surveying - Boundary DisputesAerial Close-up Ltd recently supplied low-level aerial photographs clearly illustrating the circumstances relating to a boundary dispute which had been going on for several years. It was rumoured that the legal costs alone before going to court had reached £20,000. Happily, their client won the case and, in his summing up, the Judge actually praised the aerial photographs submitted “as being of the highest quality and clearly defined the point at issue.” Aerial Close-up Ltd has also worked for a local authority in a case involving encroachment. The land in question had become landlocked after the authority developed part of the land leaving the remainder to became overgrown. This resulted in the surrounding householders encroaching upon this land by extending their gardens. Much to the council’s embarrassment, they could no longer gain access to their own land to inspect the encroachment. They had already purchased several aerial photographs from an aircraft but were unable to pick up sufficient detail for serving notice on the householders. The solution to the problem was for Aerial Close-up Ltd to park in the road at the front of each house and photograph across the rooftop directly into the garden at the rear. These low-level aerial images clearly showed both the old and the new fence panels, the original boundary line and the full extent of the encroachment. |
